ImPACT Applications Privacy Policy
The ImPACT Applications, Inc. Privacy Policy (the "Policy") governs your use of the ImPACT's website located at www.impacttest.com and related websites such as www.impacttestcenter.com/results (the "ImPACT Site") which are operated by ImPACT Applications, Inc. ("ImPACT") and/or any of ImPACT's affiliates, and your use of the ImPACT Test (the "Test") on other websites on which the Test appears such as www.headsmarthockey.com. This Policy does not apply to ideas, concepts, suggestions or inventions that you send to via email to ImPACT. Please do not send such correspondence to ImPACT if your intent is to keep such matters private.
The ImPACT Site may occasionally provide links to other websites owned and/or operated by third parties. ImPACT shall not be responsible for the operation of such other sites, including such other site's privacy practices or lack thereof. When visiting any such third party site you should review the privacy statements/policies of each site which you end up visiting through your use of the ImPACT Site.
Registration and Access to Services
Although many aspects of the ImPACT Site are available without having to register or take the Test, some of the content and functionality of the ImPACT Site, including the ability to take and review the results of the Test, require you to register. If you register on the ImPACT Site to take the Test or gain access to other content or functionality on the ImPACT Site, you will be required to submit information which could be used to personally identify you ("Personally Identifiable Information"). If you register to take the Test, you will also be required to provide ImPACT with information concerning your health including, but not limited to, your weight, height, current and past treatments and medications, symptoms, and other related medical information ("Personal Medical Information"). In order for the Test and other aspects of the ImPACT Site to be beneficial to you and operate in the manner they were designed to operate, you must provide Personal Medical Information and Personally Identifiable Information that is accurate and complete.
Information We Collect About You
When you register as a user on the ImPACT Site (or update/change your user profile) ImPACT collects Personally Identifiable Information about you. ImPACT utilizes this Personally Identifiable Information to provide you with data related to the Test, provide you with content that you may request, send emails to you regarding questions about the ImPACT Site, the Test and support, and to inform you of significant changes to this Policy.
Use of the ImPACT Site by Children
ImPACT believes that protecting the privacy of children is important. Although the content on the ImPACT Site and the Test may be used by a parent or guardian of a child under the age of thirteen to benefit such a child, neither ImPACT nor any of its services are designed or intended to attract children under the age of 13. Although ImPACT does not knowingly collect Personally Identifiable Information from a person ImPACT actually knows is under the age of 13, ImPACT does allow a child's parent or guardian, to establish a user profile and use the Test. The parent or guardian is solely responsible for providing supervision of the child's use of the ImPACT Site and/or the Test and a parent or guardian who registers a child shall assume full responsibility for ensuring that the registration information is kept secure and that the information submitted is accurate and complete. Any such parent or guardian also assumes full responsibility for the interpretation and use of any information or suggestions provided through the ImPACT Site and/or the Test for the minor.
ImPACT's Disclosure of your Information
Except as set forth in this Policy or as specifically agreed to by you, ImPACT will not disclose any Personally Identifiable or Personal Medical Information gathered from you on the ImPACT Site or the Test. You agree that ImPACT may release Personally Identifiable or Personal Medical Information: (1) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in response to a physical threat to you or others, to protect property or defend or assert legal rights. In the event that ImPACT is legally compelled to disclose your Personally Identifiable or Personal Medical Information to a third party, ImPACT will attempt to notify you unless doing so would violate the law or court order. In addition, we may disclose Personally Identifiable Information as described below.
ImPACT's programming and service providers may have or be granted from time-to-time limited access to your Personally Identifiable Information in the course of providing services to ImPACT in support of the ImPACT Site and/or Test. Such third party providers may include vendors and suppliers that provide ImPACT with technology, services, and/or content for the operation and maintenance of the ImPACT Site and/or Test. These contractors also may have access to your email address to send newsletters or special promotions to you on our behalf or to send emails to you for purposes such as conducting market research form ImPACT. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for ImPACT. ImPACT requires all third party service providers to execute binding agreement in which the third party agrees to: (1) protect the privacy of your Personally Identifiable Information consistent with this Policy, and (2) not use or disclose your Personally Identifiable Information for any purpose other than providing ImPACT with products and services as required by law.
ImPACT may also use your Personally Identifiable Information, along with the Personally Identifiable Information of all or some of the other users of the ImPACT Site for research purposes (the "Aggregated Data"). ImPACT may desire to use the Aggregated Data in an effort to discover certain trends in testing results, certain aspects of the Test which require refinement, etc. ImPACT may also use the Aggregated Data to provide third parties with information on user patterns such as the time users spend on a certain portion of the ImPACT Site, the average age of individuals taking the Test, etc. ImPACT might also provide certain third parties, such as sports equipment manufacturers or research institutions, data regarding the percentage of individuals suffering neurocognitive injury who play certain sports such as football, the age/sex of such individuals and/or how many of those individuals had a history of related health problem prior to taking the Test. ImPACT may receive compensation from such third parties for their use of such information. ImPACT requires parties who receive Aggregated Data to agree that they will not attempt to make this information personally identifiable, such as by combining it with other databases.
ImPACT's Ability to Change the Policy
ImPACT reserves the right, in its sole and absolute discretion, to amend this Policy from time-to-time. In the event such an amendment constitutes a "material" change (as defined below) in the collection and/or aggregation of Personally Identifiable Information, ImPACT will notify you in advance of such proposed change and will provide you with an ability to "opt-out" of your registration on the ImPACT Site. For purposes of this Policy, "material" means a change which expands the ImPACT's ability to collect, use or disclose Personally Identifiable Information and/or Personal Medical Information. If, following ImPACT's adoption of a material change, you continue to use the ImPACT Site, such continued use will constitute your acceptance of such material change(s). If you decide that any of the material changes are not acceptable to you then you should immediately stop using the ImPACT Site.
